These Terms of Use govern your access to and use of the Cadence Days app and related services provided by Sunstar Macedon.
By accessing or using Cadence Days, you agree to these Terms of Use.
1. About Cadence Days
Cadence Days is a cycle tracking app that allows users to log cycle information, view estimated cycle-related dates, manage tracking profiles, receive reminders, and optionally share cycle updates with trusted people.
Cadence Days is provided for informational and personal tracking purposes only.
Cadence Days does not provide medical advice, diagnosis, treatment, fertility treatment guidance, or contraception guidance.
2. Eligibility
You may use Cadence Days only if you are legally able to enter into a binding agreement under applicable law.
If you use Cadence Days on behalf of another person, you represent that you have the authority and permission to do so.
3. Accounts
You may need to create an account to use some or all features of Cadence Days.
You are responsible for:
- providing accurate account information
- maintaining the confidentiality of your login credentials
- activities that occur under your account
- promptly notifying us of suspected unauthorized access
4. Acceptable Use
You agree not to:
- use Cadence Days for unlawful purposes
- interfere with or disrupt the service
- attempt unauthorized access to accounts, systems, or data
- misuse the sharing features
- upload or submit misleading, abusive, or fraudulent information
- reverse engineer or attempt to extract source code except where allowed by law
5. Cycle Predictions and No Medical Advice
Cadence Days may provide estimates for future cycle events, including period dates, fertile windows, and ovulation timing.
These predictions are estimates only.
Cadence Days is not medical advice, diagnosis, treatment, fertility treatment guidance, or contraception guidance. You should not rely on Cadence Days for medical decisions, emergency care, or pregnancy prevention.
If you have health concerns, consult a qualified medical professional.
7. Plans, Billing, and Subscription Access
Cadence Days may offer different plans, including:
- a free plan that can share out but cannot accept shared cycles
- a 2 EUR plan that can accept 1 shared cycle
- a 5 EUR plan that can accept up to 5 shared cycles
Paid features may be billed and managed through:
- Apple
Plan pricing, features, billing terms, renewal terms, taxes, refunds, and availability may change as permitted by applicable law and platform billing rules.
If paid plans are offered through Apple or Google in-app purchases, billing and cancellation may also be governed by the applicable app store terms.
8. Data and Privacy
Your use of Cadence Days is also governed by the Cadence Days Privacy Policy at https://sunstarmacedon.com/privacy-cadence-days.html.
9. Intellectual Property
Cadence Days, including its software, branding, text, graphics, design, and related materials, is owned by or licensed to Sunstar Macedon and is protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Cadence Days for personal, non-commercial use unless otherwise agreed in writing.
10. Service Availability and Changes
We may modify, suspend, or discontinue any part of Cadence Days at any time, with or without notice, as permitted by law.
We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.
11. Account Suspension or Termination
We may suspend or terminate access to Cadence Days if:
- you violate these Terms
- your use creates risk or legal exposure
- we are required to do so by law
- necessary for security, fraud prevention, or service integrity
You may stop using the service at any time. If your account supports deletion, you may initiate deletion in the app or through the web deletion page.
12. Disclaimer of Warranties
To the maximum extent permitted by law, Cadence Days is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of predictions or outputs.
13. Limitation of Liability
To the maximum extent permitted by law, Sunstar Macedon and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, or business opportunities arising out of or related to your use of Cadence Days.
To the maximum extent permitted by law, our total liability for claims arising out of or relating to Cadence Days will not exceed the amount you paid to use the service during the 12 months before the event giving rise to the claim, or 50 EUR if you paid nothing.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Sunstar Macedon from claims, damages, liabilities, and expenses arising out of your misuse of Cadence Days, your violation of these Terms, or your infringement of another party's rights.
15. Governing Law
These Terms are governed by the laws of North Macedonia, without regard to conflict of laws principles, unless applicable consumer protection law requires otherwise.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the app, website, or other appropriate means.
